TERMS AND CONDITIONS
In these terms and conditions, “we” “us” and “our” refers to Morgan Holistic Health Practitioner Limited.
By ordering a product or services offered by us you agree to be bound by our terms and conditions set out below.
If you do not agree with any of these Terms and Conditions, please do not order any products or services from us.
We reserve the right to change, update or reissue these Terms and Conditions at any time. Any such changes will be posted to our website and you agree to be bound by such changes.
OUR SERVICES
All prices are in New Zealand Dollars (NZD) and are inclusive of GST. We endeavour to ensure that our price list is current but we reserve the right to amend our prices from time to time.
INTELLECTUAL PROPERTY RIGHTS
The copyright to all content on this website and services provided including graphics, images, layouts and text belongs to us or we have a licence to use those materials.
All trade marks, brands and logos which are used on this website are either owned by us or we have a licence to use them. Your access to our website does not license you to use those marks in any commercial way without our prior written permission.
DISCLAIMERS AND LIMITATION OF LIABILITY
Prior to undertaking any of our services, you should consult with your doctor or other healthcare practitioner to ensure that you are mindful of your current health and any restrictions that may be appropriate for you.
You must notify us if you have any pre-existing injuries or medical conditions which may impact upon your use of our services or products
You expressly agree that your use of, or inability to use, the services we provide is at your sole risk. All products and services delivered to you are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
To the full extent permitted by law, in no case shall we, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of our services or any products, or for any other claim related in any way to your use of our services or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of our services or any content (or product) posted, transmitted, or otherwise made available to you, even if advised of their possibility.
Any unenforceable or void provision, or part thereof, may be severed from these Terms and Conditions without affecting the validity of the remaining provisions.
FORCE MAJEURE
“Force Majeure” means any act, circumstance or omission over which we could not reasonably have exercised control. This includes, but is not limited to, any restriction on operation that is imposed by local or national authorities as a result of pandemic, epidemic natural disaster, or other significant event.
If a Force Majeure event prevents us from operating, we will endeavour to provide online communications to a similar schedule to our usual meetings.
JURISDICTION
These terms and conditions are to be governed by and construed in accordance with the laws of New Zealand and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in New Zealand and you agree to submit to the jurisdiction of those Courts.
If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.
PRIVACY
We undertake to only collect personal information from you that is necessary to enable us to provide our services to you. Such information is collected solely for the purposes of informing you about services and products we offer, and providing those services or products to you.
We will take all due care with any information which you may provide to us to protect against unauthorised loss, access, use, modification, disclosure or other misuse of your personal information. However we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
You are entitled to request confirmation of whether we hold any personal information about you, and request access to any such personal information about you. You are entitled to request correction of any personal information we hold about you. Such requests should be emailed to: morganspittal@gmail.com. We will endeavour to respond to any such request as soon as reasonably practicable.
SITE ACCESS
When you visit our website, we give you a limited licence to access and use our information for personal use.
You are permitted to download a copy of the information on this website or our services to your computer for your personal use only provided that you do not delete or change any copyright symbol, trade mark or other proprietary notice. Your use of our content in any other way infringes our intellectual property rights.
